5Returns Policy

5.1We will replace at no extra cost any Goods damaged before or on delivery, if you notify us by telephone or in writing within 5 days of their receipt. 

 

5.2We will replace at no extra cost any Goods which have been lost in transit if you notify us by telephone or in writing within 21 days of us receiving your Order or the publication date of the Goods, whichever shall be the later.  

 

5.3 GCC 's acknowledgement must be sought before any goods are returned for credit.

6Revision of Terms and Conditions

6.1 GCC may at any time revise these Terms and Conditions without notice by posting changes on-line. Users are responsible for reviewing all information posted on-line, and the continued use of GCC websites, after changes are posted, constitute the user's acceptance of modified Terms and Conditions.

GCC Acquisition Agreement

 

Carefully read these terms under which GCC provides Products to you. For your order to be accepted, Product delivery must be to a valid address. You agree that the terms of this GCC Acquisition Agreement ("Agreement") will apply by:

1)      clicking your acceptance of these terms,

2)     your act of ordering the Product(s),

3)     making payment for a Product, or

4)     your initial use of the Product(s), and that each of such acts is acceptable as a signed writing.

A Product becomes subject to this Agreement when GCC accepts your order by sending you a Transaction Document or by shipping the Machine or making the Program available to you. Confirmation of GCC’s receipt of your order does not constitute GCC’s acceptance of your order. This Agreement, including its Attachments and Transaction Documents, if any, is intended to be the complete agreement between you and GCC regarding your acquisition of the Products and is intended to replace any prior oral or written communications between you and GCC. Please read these terms carefully to ensure that there is no conflict with any prior communications. Any additional or different terms in any order or written communications from you are void.

 

1. Definitions

 

Date of Installation is:

 

for a Machine GCC is responsible for installing, the business day after

·        the day GCC installs it or, if you defer installation, the day GCC makes it available to you for subsequent installation by GCC.

·        for a Machine that you are responsible for installing and a non-GCC Machine, the second business day after the Machine's standard transit allowance period.

·        for a Program, the latest of -

·        the day after its testing period ends,

·        the second business day after the Program's standard transit allowance period,

·        the date, specified in a Transaction Document, on which GCC authorises you to make a copy of the Program, or

·        the date you distribute a copy of a chargeable component in support of your authorised use of the Program.

 

Designated Machine is:

·        the machine on which you will use a Program for processing and which GCC requires you to identify to it by type/model and serial number, or

·        any machine on which you use the Program if GCC does not require you to provide this identification to GCC.

 

Enterprise is:

·        any legal entity (such as a corporation) and the subsidiaries it owns by more than 50 percent. The term "Enterprise" applies only to the portion of the enterprise located in the United Kingdom.

 

Machine is:

·        a machine, its features, conversions, upgrades, elements, or accessories, or any combination of them. The term "Machine" includes an GCC Machine and any non- GCC Machine (including other equipment) that GCC may provide to you. Non- GCC Machines include products which are not manufactured, warranted, or supported by GCC but may carry the GCC logo under license from GCC. Such non- GCC Machines will be identified accordingly.

 

Product is:

·        a Machine or

·         a Program.

 

Program is:

·        a computer software program, whether pre-loaded on a Machine or provided separately, including related licensed materials such as documentation.

 

Specifications is:

·        a document that provides information specific to a Product.

·       For a GCC Machine, GCC calls the document "Official Published Specifications."

·       For an GCC Program, GCC calls it "Licensed Program Specifications," or "License Information."

 

Specified Operating Environment is the Machines and Programs with which a Program is designed to operate, as described in the Program's Specifications.

 

2. Agreement Structure

 

Some GCC Products have additional terms such as associated warranty statements and license agreements. GCC provides the additional terms in documents called "Attachments", which are also part of this Agreement. Attachments will be signed by both of us if requested by either of us.

Additional details of each transaction may be set out in "Transaction Documents" such as addenda, exhibits, invoices, order acceptance and supplements, all of which are part of this Agreement, that confirm the specific details of the transaction.

If there is a conflict among the terms in the various documents, those of an Attachment prevail over those of this Agreement. The terms of a Transaction Document prevail over those of both of these documents.

 

3. Delivery

 

Although GCC does not warrant that delivery will be made within 30 days, GCC will use reasonable efforts to do so. In GCC 's acceptance of your order, GCC will notify you regarding the expected delivery date.

 

4. Charges and Payment

 

If a Product is quoted at an incorrect price due to typographical error or error in pricing information:

 

(1) GCC has the right to refuse or cancel any orders placed for the Product quoted at the incorrect price, even if GCC has confirmed the receipt of your order and charged you.

 

(2) if GCC has charged you but subsequently cancelled your order, GCC will issue a credit to your account for the amount charged.

 

Amounts are due upon receipt of invoice and payable as we specify in a Transaction Document. You agree to pay accordingly, including any late payment charges.

 

If payment for a one-time charge is not made within 30 (thirty) days from the date of invoice or payment for recurring charges is not made within 60 (sixty) days from the date of invoice, you may be subject to late payment charges. Such charges will be calculated at a monthly rate of 2% of the invoice amount, compounded for each period or part period of 30 (thirty) days that the invoice remains unpaid.

 

Our rights relating to late payment charges shall be in addition to any other right that we may have in the event that you fail to make any payment due to us under this Agreement.

 

For all transactions, we reserve the right to require payment in advance of delivery or other security for payment.

 

If any authority imposes a duty, tax, levy, or fee, excluding those based on our net income, upon any transaction under this Agreement, then you agree to pay that amount as specified in the invoice or supply exemption documentation.

 

5. Other Parties Promoting GCC Products

 

GCC may have agreements with certain organisations to promote and support certain Products. When you order GCC Products (promoted to you by such organisations) under this Agreement, GCC confirms that it is responsible for providing the Products to you under the warranties and other terms of this Agreement.

GCC is not responsible for:

·        the actions of any of those organisations,

·        any additional obligations they have to you, or

·        any products or services that they supply to you under their agreements.

 

6. Responsibilities

 

Both of us agree that under this Agreement:
